Subscription Agreement
This Exaggy Subscription Agreement is a legal contract between you and Exaggy governing your purchase and use of the premium subscription services offered within the Exaggy mobile application. By purchasing a Subscription Service through Apple’s InApp Purchase system, you agree to be bound by the terms of this Agreement and the Exaggy Terms of Use and Privacy Policy. We explicitly state that we DO NOT collect, store, or process any facial information from any materials you use in the App, whether you are a free user or a subscriber.
1. Subscription Services Overview
Exaggy offers premium Subscription Services that unlock additional features not available in the free version of the App, such as:
Priority access to new features and updates.
The specific Subscription Service plans (e.g., monthly, annual) are subject to change, and the available plans will be displayed in the App’s InApp Purchase section at the time of your purchase.
2. Subscription Pricing and Payment
2.1 Pricing
The price of the Subscription Services is displayed in the App’s InApp Purchase section, in your local currency. Prices are subject to change, but any changes will not affect your current subscription period.
2.2 Payment
Payment for Subscription Services is processed through Apple’s official InApp Purchase framework. By initiating a purchase, you authorize Apple to charge your selected payment method (e.g., credit card, Apple Pay) for the subscription fee. We do not receive or store any of your payment information; all payment related data is managed solely by Apple.
2.3 AutoRenewal
Unless you cancel your subscription at least 24 hours before the end of the current subscription period, your subscription will automatically renew for the same duration and at the then current price. Apple will charge your payment method within 24 hours prior to the end of the current period. You can manage your subscription and turn off autorenewal at any time through your Apple ID account settings.
3. Subscription Activation and Duration
Your Subscription Service will be activated immediately upon successful payment. The duration of your subscription (e.g., 1 month, 1 year) will be clearly stated at the time of purchase.
You may cancel your subscription at any time, but we do not offer refunds for any unused portion of a subscription period, except as required by applicable law or Apple’s InApp Purchase refund policy.
4. Privacy and Data Handling for Subscribers
As a subscriber, your privacy is still our top priority, and we adhere to the same strict data handling practices outlined in the Exaggy Privacy Policy:
No Facial Information Collection: We do not collect, store, or process any facial information from the images or photos you use to create memes, whether you are using free or premium features. All image processing, including the application of premium effects, is performed locally on your iOS device.
No Account Required for Subscriptions: Even as a subscriber, you are not required to create an account or provide any personal information. Your subscription status is managed directly through your Apple ID, and we do not link your subscription to any personally identifiable information or facial data.
No Tracking of Subscriber Activity: We do not track your usage of premium features or collect data about the memes you create as a subscriber for the purpose of profiling or targeted advertising.
5. Subscriber Obligations
As a subscriber, you agree to comply with the Exaggy Terms of Use and this Agreement. You may not:
Share your subscription or Apple ID with any third party to allow them to access the Subscription Services.
Use the Subscription Services for any illegal, unauthorized, or infringing purposes, including the creation or sharing of memes that violate third party rights or applicable laws.
Rever seengineer, modify, or distribute the premium features of the App.
6. Modification or Discontinuation of Subscription Services
We reserve the right to modify, suspend, or discontinue any part of the Subscription Services at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Subscription Services. If we discontinue the Subscription Services entirely, we will provide you with a prorated refund for any unused portion of your subscription period, as required by applicable law.
7. Disclaimer of Warranties
THE SUBSCRIPTION SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE MAKE NO WARRANTY THAT THE SUBSCRIPTION SERVICES WILL BE ERROR FREE, UNINTERRUPTED, OR COMPATIBLE WITH YOUR DEVICE.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EXAGGY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SUBSCRIPTION SERVICES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATED TO THE SUBSCRIPTION SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID FOR THE SUBSCRIPTION IN THE 12MONTH PERIOD PRIOR TO THE CLAIM.
9. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of California, USA, without regard to its conflict of law principles.
